Sponsor: Electronics Boutique Canada Inc. (GameStop / GameStop Canada) – 8995 Airport Road, Brampton, Ontario, L6T 5T2 (“Sponsor”).

Term: The Tell GameStop Contest (“Contest”) begins on August 1, 2011, at 12:00:01 a.m. Eastern Time (“ET”), and ends on December 31, 2016 at 11:59:59 p.m. ET (“Term”). A drawing will be held for each calendar month during the Term.

Eligibility: Contest is open to all legal residents of Canada, who are of or are above the age of majority in the province or territory in which they reside at the time of entry. Void where prohibited. Employees, representatives and agents of Sponsor, Electronic Boutique Canada Inc. and their affiliated companies, as well as the persons with whom they are domiciled are not eligible. By entering this Contest, all entrants agree to comply with and be bound by these Official Rules, and to comply with all applicable federal, provincial and local laws and regulations.

How To Enter: No purchase necessary to enter or win the Contest.  Limit of one (1) sweepstakes entry, per individual, per month.

To enter the Contest:

1) Complete the survey at www.tellgamestop.ca during the Term by using the feedback number on your receipt.  Once the survey is completed, complete the registration page with your name, address, phone number and email address and click on the "submit" button and you will automatically receive one (1) entry.2)  If you do not wish to complete the survey, have not made a purchase, or do not have a receipt, visit www.gamestop.ca or www.gamestop.ca and click on the “Contest” link for an alternate entry form or visit www.tellgamestop.ca.  Complete the registration page with your name, address, phone number, and email address and click “submit” button and you will automatically receive one (1) entry.

The registration page must be completely filled out to constitute an eligible entry. Use of any automated entry software is prohibited.

Prizes: Sponsor will award five (5) winners one (1) one hundred dollar ($100) GameStop Gift Card (approximate retail value of each prize: $100.00) each month during the Term. Approximate retail value of all prizes available to be won: $6,000. No more than the stated number of prizes will be awarded.

Winner Selection: For each month during the Term, five (5) entries will be selected in a random drawing from among all eligible entries received during that month of the Term. The drawing will take place at 2:00 PM ET on the fifth (5th) business day of the month immediately following the end of each month during the Term at 625 Panorama Trail, Suite 2100, Rochester, NY 14625. The drawing will be conducted by Sponsor or Independent Contest Administrator. Selected entrants will be contacted by e-mail or by phone at the e-mail address or phone number provided on the registration page. In order to be declared a confirmed winner (“Winner”), each selected entrant will be required: (a) to complete, sign and return a Declaration of Compliance within four (4) calendar days from the date of notification; and (b) to correctly answer a time-limited mathematical skill-testing question without assistance or mechanical aid. Failure to return the documents and/or information requested, or the return of any prize or prize notification as undeliverable, or if a Winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize will be forfeited and an alternate potential winner may be selected in a random drawing from among all remaining eligible entries. Prizes will be delivered six (6) to eight (8) weeks from the date on which the Winner is confirmed. All decisions of Sponsor are final. Odds of winning each prize are dependent upon number of eligible entries received.

Prize Restrictions: Limit one (1) prize per individual during the Term. Prizes are non-transferable, and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should the prize become unavailable for any reason. By accepting any prize, Winners consent to use of their name or likeness for advertising/publicity purposes without further remuneration or notification, except where prohibited by law.

Privacy:  Any information collected will be subject to Sponsor’s Privacy Policy, located at http://www.gamestop.ca/Help/Index?section=Privacy (the “Policy”).  By entering the Contest, you acknowledge that you have agreed to such Policy and you consent to the collection, use and disclosure of your personal information for the purposes of administering this Contest in accordance with such Policy.  If you wish to access or correct your personal information held by us, opt out of receiving further communications from us or our affiliated merchants or companies, or have other questions respecting our privacy policy, please contact us at help@gamestop.ca.

Conduct: By participating, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Contest. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any Sponsor web site; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

Release and Limitation of Liability: To the extent permitted by applicable law, by entering this Contest, entrants release and hold harmless Sponsor and its respective parent, subsidiaries, affiliates, directors, officers, employees, representatives and agents (collectively, “Releasees”) from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of a prize or arising out of participation in this Contest. To the extent permitted by applicable law, Sponsor assumes no responsibility or liability for (1) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (3) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participation in this Contest or downloading any materials related to this Contest; (4) technical or human error which may occur in the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize.

Internet: If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Contest, subject to the approval of the Régie des alcools, des courses et des jeux in Québec.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Force Majeure: The failure of the Releasees to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable laws and regulations) or other force majeure event will not be considered a breach of these Official Rules.

Disputes: Except where prohibited or otherwise outlined in these Official Rules, and to the extent permitted by law, by entering this Contest, each entrant agrees that:
(1) except with respects to residents of Québec, any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate courts of Ontario;
(2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and,
(3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Except with respects to residents of Québec, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules. 

For Residents of Québec Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
